1. Terms of use:  This section sets out the terms of use of this website ("Site"). By accessing this Site, using or purchasing any service or product through this Site, you are agreeing to these Terms. This Site is primarily intended for those who access it from or within Hong Kong. You as visitors, viewers or users of this Site, any service or product through this Site are wholly responsible for use of this Site, the services and products, and verifying due compliance with these Terms and all applicable laws in Hong Kong. Making available information about this Site does not constitute an offer, solicitation, endorsement or recommendation of this Site, or any product or service provided by us or third party service providers. The information including all services and products provided through this Site is not intended for distribution to, or use by, any person in any jurisdiction where such distribution or use would be strictly prohibited or unlawful. We do not represent or warrant that any product or service you may view on or purchase through this Site are or must be suitable for you or any particular person or purpose. You acknowledge that (a) we have not solicited your use of this Site, any product or service provided through this Site, or any request for information you have made as a result of using this Site, any product or service provided through this Site; and (b) any information, service or product provided through this Site does not constitute and should not be considered legal, accounting, financial, investment or professional advice. If in doubt you should seek your own independent legal, accounting, financial, investment and professional advice. If your doubt persists, please immediately leave this Site and stop using this Site.

Trademarks and copyright:  We and third party service providers as appropriate own the trademarks, trade names, logos and service marks that are used or displayed on this Site, the products and services provided through this Site. You are not allowed to use any such trademarks, trade names, logos or service marks on this Site, all products and services provided through this Site, without our or such third party service providers' prior written approval. Materials including all services and products provided through this Site are protected by copyright.

No representation and warranty:  We or third party service providers use reasonable care and skill to ensure the accuracy of the information we provide through this Site and in all services or products provided through this Site. However, we do not accept liability for any errors or omissions in this Site and reserve the right to change information, prices, specifications and descriptions of listed services and products at any time and without notice.  In particular, no warranty about anti-piracy, non-infringement, security, accuracy, fitness for a particular purpose or absence of computer viruses is given in relation to any information shown in this Site.

4. Linked or hyperlinked websites:  We accept no liability for the content or information (including any service or product) available on or the set-up of any other websites linked to this Site. Your access to and use of an external website linked to this Site is at your own risk and subject to the terms and conditions applicable to such access and use. By providing hyperlinks or hypertext links to an external website, we shall not be deemed to endorse, recommend, approve, guarantee or introduce any third party service providers, and such services or products they provide on the external website, or have any form of cooperation with such third party service providers and the external website. We are not and will not in any event be deemed a party to any contractual arrangement entered into between you and the third party service providers of any external website, service or product.

Telecommunication over the Internet:  In view of the inherent nature of the Internet, all communications and transactions exchanged or conducted over the Internet may be subject to data interruption, alteration, corruption, transmission blackout, delayed or incorrect transmission. We accept no liability for any mistake, error, malfunction in communications and transactions facilities beyond our control that may affect the truth, correctness, accuracy or timeliness of communications and transactions you transmit and conduct. We are entitled in our sole and absolute discretion to delay taking action or refuse to act on an instruction if we are aware of or suspect any breach of security, conflict of interest, issue of money laundering or terrorist financing or other unlawful or suspicious circumstance relating to the use of this Site.

Downloading and other security measures:  We do not represent or warrant that (a) this Site and all products and services provided through this Site will be available and can meet your requirements; (b) your access to this Site will not be interrupted; (c) there will be no delay, failure, mistake, error or omission or loss of information in transmission; (d) no viruses, contamination, destructive or otherwise inappropriate properties will be transmitted; and (e) no damage may occur to your or our computer system.  You are and shall be solely responsible for (a) adequate protection and back-up of data (including all services and products provided through this Site, as appropriate) and equipment; (b) undertaking reasonable and appropriate precautions to scan for computer viruses and other contaminating, destructive or otherwise inappropriate properties; and (c) keeping your personal information, which we or third party service providers use to identify you for conducting certain transactions available in this Site, secured or insulated from unauthorized use. We do not represent or warrant the accuracy, functionality, quality and performance of our or any third party service providers' hardware and software that may be used in connection with this Site.

7. Ordering and delivery process:  When placing an order at this Site, you agree that any and all information you give us is true, accurate and complete. All orders are subject to acceptance, product and/or service availability. All prices listed on this Site are correct at the time of entering the information but we reserve the right to change prices of any service or product at any time without prior notice. No contract for the sale of any service or product provided through this Site will exist between you and us at this Site until we accept your order and full payment. If your order cannot be processed, you will receive an email from us informing you of the reasons why and our suggested solution. If you are not happy with our suggested solution, you may decide to cancel your purchase and obtain a full refund.  Your ordered service or product is delivered by way of your electronic or digital downloading over the Internet only.  Once your ordered service or product at this Site has been delivered, no cancellation of order or return delivery request will be entertained or accepted. 

8. Payment process:  You may purchase services or products from this Site with PayPal and/or your credit card payment. If PayPal and/or your credit card issuer refuses to authorise payment to us, we accept no liability for any delay or non-delivery. We are sorry that we cannot accept personal cheque, cashier's order, money order or direct deposit.  Once your order for the service or product provided through this Site has been processed, completed or delivered, no refund request will be entertained or accepted.

9. Limitation of liability:  We cannot guarantee that this Site, all services and products provided through this Site will be 100% accurate or up to date. You acknowledge that you use this Site, and all services and products provided through this Site at your own risk. Except as provided by law, this Site and all services and products provided through this Site are provided on an “as is” and “as available” basis and without any warranty or representation, whether express or implied.  To the fullest extent permitted by law, we exclude all implied representations and warranties (including, but not limited to, those in relation to merchantability and fitness for a particular purpose) which, but for the terms, might apply in relation to your use of this Site, and the services or products provided through this Site.  In any event, we accept no liability for (a) loss that was not reasonably foreseeable; (b) loss that was not caused by our breach of contract or by our negligence; (c) indirect or secondary loss that arises from any breach by us; (d) losses that relate to a business, such as lost data, lost profits or business interruption, that you or a third person is engaged in; (e) losses caused by any inaccuracy or incorrectness in the information you provide to us, such as order, delivery or payment information; or (f) any increase in loss that was caused by your breach of contract or your negligence. You must take all reasonable steps to minimize the extent of any loss you may suffer as a result of your use of this Site, and any service or product purchased through this Site. We shall have no liability to you for any delay in the delivery of services or products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including, but not limited to, acts of god, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events. Our maximum liability to you in relation to your use of this Site or any service or product provided through this Site is the amount paid by you for the item that is the subject of the claim.

Privacy policy:  We abide by applicable personal data collection and protection rules and regulations in Hong Kong. If you have opted to use PayPal and/or credit card payment to make your purchase through this Site, then you consent to the use of your information by PayPal and/or your credit card issuer in accordance with PayPal's and/or your credit card issuer's privacy policy.

Personal data we hold:  Personal data held by us include such information as your name, address and other contact details which were collected from you directly and also such information as your selected products and/or services at this Site or from us that were gathered during the course of your dealings with us.

Access and correction of personal data:  You have a right to request access to, and the correction of, your personal data in accordance with the provisions of the Personal Data (Privacy) Ordinance (Cap. 486). Direct marketing:  Our related companies, including the holding company and its fellow subsidiaries and affiliated companies owned and/or controlled by the same sole proprietor in Hong Kong, may use your name, contact phone number, correspondence address, email address, your selected products and/or services, and related consumption data (as appropriate) for marketing our products and/or services, and our organised events. If you wish us to unsubscribe or exclude your personal data for direct marketing purposes, please send us an email, along with your name, contact phone number, email address and any information that can assist to identify you to us to our Data Protection Officer at info@mokco.com.hk.
